HOW TO ENTER: Slate V's Comedy News Contest (hereinafter, "Contest") runs from 12:01 am EDT Thursday Oct. 11, 2007 through 11:59 pm EDT on Friday, Oct. 26, 2007 (the "Entry Period"). Eligible persons may enter by visiting the Contest link at: www.slatev.com/comedynews.
ELIGIBILITY: The Contest is open only to persons who are (i) legal residents of the United States (including the District of Columbia); (ii) above the age of majority in the state in which they reside; and (iii) who have access to the Internet as of October 11, 2007. Employees and their immediate families, including household members, of Slate Magazine ("Sponsor") and Brightcove and their parents, affiliates, subsidiaries, divisions, advertising and promotion agencies are not eligible.
HOW TO ENTER: No purchase necessary. Only one entry per person. There are two steps to entry:
(1) Register for a free Brightcove account by entering your personal information, including your name and email address and proceed to upload your Recording (as defined below). You must have the ability and equipment to record digital video in one of the acceptable formats, as described in item (g) below, and then upload it to the Internet. A broadband Internet connection is highly recommended.
(2) To compete for the prize, you must submit one digital video recording of no more than twenty-five (25) seconds in length ("Recording"). The content of the Recording must include an original joke or humorous observation about a current or recent item in the news. In addition, the Recording must meet the following criteria:
(a) It must provide both an audio and visual of the contestant;
(b) The video and audio recording quality must be sufficient for you to be clearly seen and for your words to be clearly understood;
(c) It must not be defamatory or libelous;
(d) It must be original and you must ensure that you have all the rights necessary to allow the Sponsor to use the Recording as set forth herein;
(e) It must not infringe on any third party’s intellectual property rights, privacy or publicity rights;
(f) It must not be no longer than 25 seconds in length; and
(g) It must be in one of the following formats: 3GP, .DV, h.264, .MPEG2, .MPEG4, QuickTime, WMV, and AVI (from a Windows machine).
Note: Incomplete entries will not be considered for a prize.
GRANT. By entering, you grant Sponsor the unrestricted, royalty free, perpetual right to display, modify, perform, copy and create a derivative work from your Recording.
CONDITIONS OF ENTRY. By entering the Contest, you agree to these Official Rules, including all eligibility requirements. You consent to Sponsor's use of your name for promotional purposes, including online announcements, without additional compensation, except where prohibited by law. Furthermore, by entering the Contest, you consent to the Sponsor's and its partner, affiliates and subsidiaries use, reproduction, and display of the Recording without further compensation to you. Neither Sponsor, its parent, nor its respective affiliates, subsidiaries, divisions, advertising and promotion agencies, or any telephone network or service providers are responsible for the incorrect or inaccurate transcription of entry information; any human error, technical malfunctions, or lost/delayed data transmission; any omission, interruption, deletion, defect, or line failures of any telephone network, computer equipment, or software; inability to access any website or online service, or any other error or malfunction, or late, lost, or misdirected entries.
PRIZES: One (1) Grand Prize winner will receive $500.00 U.S. dollars. All taxes are the sole responsibility of the winner. In addition, the winning video and four (4) runners up will be displayed together on Sponsor’s web site and recognized as the Contest’s best videos in the opinion of the judge(s). Winner may not substitute, transfer or exchange the prize for any reason. No refunds or compensation will be made for any reason, including cancellation of the Contest.
HOW TO WIN: There are two rounds to the judging of the entries.
Round One: Recordings will be judged by a panel of judges from Slate staff, who will evaluate the Recordings based upon the following criteria:
Humor: 40%
Clarity of video and audio: 20%
Originality: 20%
Topical relevance: 20%
Using these criteria, the judges will assign a score to each Recording and will select ten (10) Recordings with the highest scores as the "Finalists." In the event of a tie between two possible Finalists, the judges will select as a Finalist the entrant with the highest score in the category of "Originality."
Round Two: The ten Finalists will then be passed to one judge who is in the entertainment and/or media industry. This judge will evaluate the Finalists based upon the following criteria:
Humor: 60%
Originality: 20%
Topical Relevance: 20%
Using these criteria, the judge will assign a score to each Recording and will select as the Grand Prize winner the Finalist who had the highest score in each category. The remaining four (4) Finalists will be selected as "runners-up" who will have their videos streamed on the Sponsor’s web site. In the event of a tie, the judge will select as the winner and/or runners-up the entrant with the highest score in the category of "Humor."
The judges' decisions are final with respect to all aspects of the Contest. The potential winner and the runners-up will be notified by e-mail and/or telephone, if available, on or about November 2, 2007. The potential winner and the runners-up may also be required to sign an affidavit of eligibility/publicity and liability release, and return it properly executed, within 7 days of attempted notification as a condition of awarding the prize. If prize notification is returned as undeliverable or the potential winner fails to return the affidavit and release as specified, the potential winner and/or the runners-up will be disqualified and an alternate winner and/or runners-up will be declared. If sufficient alternates cannot be notified prior to December 3, 2007, the unawarded prize will be forfeited. Odds of winning depend on the number of entries received and the skill of the entrants.
If, in Sponsor’s opinion, there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if technical difficulties compromise the integrity of the Contest, the Sponsor reserves the right to terminate the Contest and conduct a random drawing to award the prize using all entries received as of the termination date. Any attempt to deliberately damage the content or operation of this Contest is unlawful and subject to legal action by the Sponsor or its agents.
PRIVACY. Sponsor and Brightcove will be collecting personal information about you when you register and participate in the Contest. Sponsor and Brightcove may share this personal information in order to fulfill the requirements of the Contest, including sharing such information with promotional partners, agents and other third parties related to the Contest. In addition, Sponsor and Brightcove may, at their discretion, share your personal information with their affiliates, parent, and subsidiary companies, or other third parties whose products and services Sponsor or Brightcove believes may be of interest to you. GENERAL: This Contest is subject to all federal, state, and local laws. Void where prohibited. The winner agrees that the Sponsor, its parents, affiliates and its agencies and their respective officers, employees, managers, agents, successors or assignees shall not be liable for injury, loss or damage of any kind resulting from participating in this Contest or from the acceptance or use of any prize awarded. The Sponsor reserves the right to verify eligibility qualifications of any winner. U.S. law governs this Contest.
All submitted videos become the property of Slate Magazine. Submitted videos may or may not be publicly displayed, at the sole discretion of Slate. The submitted videos may be displayed on Slate indefinitely. Slate may also license third parties to display the videos
WINNERS LIST: For the names of the winners, after November 16, 2007, send a self-addressed stamped envelope to: Contests (Slate V) @WPNI, P.O. Box 17370, Arlington, VA, 22216-7370, and include the text: "Please send me the list of winners." Requests received more than ninety (90) days after the end of the promotion will not be honored.
